21 Day Trial Terms & Conditions
By purchasing the Spartan Performance 21 Day Trial (“the Trial”), you confirm that you have read, understood and agreed to these Terms & Conditions.
1. THE TRIAL
1.1 The Spartan Performance 21 Day Trial is a fixed-term introductory package designed to allow prospective members to experience Spartan Performance, its facilities, coaching services and training environment.
1.2 The Trial currently includes:
• Gym Access
• Class Access
• Bespoke Trial Training Programme
• Access to up to 9 Complimentary Semi-Private Personal Training Sessions
• Sauna Access
• 1 Complimentary Red Light Therapy Session
1.3 The Trial is not a membership and does not automatically renew.
1.4 Spartan Performance reserves the right to amend, replace or remove any Trial component where reasonably necessary.
2. ELIGIBILITY & SUITABILITY
2.1 The Trial is intended primarily for new clients who have not previously trained, attended classes, received coaching, held a membership, completed a trial or otherwise used Spartan Performance facilities or services in any capacity.
2.2 Spartan Performance reserves the right to verify eligibility.
2.3 Management reserves the absolute right, at its sole discretion, to waive eligibility requirements and permit participation by previous members, clients or visitors where it considers appropriate to do so.
2.4 Purchase of the Trial does not guarantee acceptance onto the Trial.
2.5 Participation remains subject to review of health screening documentation, suitability assessment and compliance with these Terms & Conditions.
2.6 Spartan Performance reserves the right to decline participation where it considers the Trial unsuitable for the individual. Any refund shall remain entirely at the discretion of management.
2.7 The Trial is intended for individuals capable of participating in general strength and fitness training without the need for rehabilitation programming, clinical exercise prescription or significant modification.
2.8 Spartan Performance reserves the sole right to determine whether an individual is suitable for the Trial.
2.9 Individuals requiring injury rehabilitation, post-operative rehabilitation, clinical exercise prescription or highly specialised programming may be directed towards a Silver, Gold or alternative coaching package.
3. START DATE & DURATION
3.1 The Trial runs for 21 consecutive calendar days from the agreed start date.
3.2 The Trial period is not paused, extended, frozen or restarted due to illness, injury, holidays, work commitments, shift patterns, family commitments, transport issues, weather conditions, personal circumstances or non-attendance.
3.3 The Trial begins only on the agreed start date.
3.4 Time between purchase and commencement of the agreed start date does not count towards the Trial period.
3.5 Spartan Performance strongly recommends that all Trials begin on a Monday wherever possible.
3.6 Trial purchases must commence within 30 days of the original purchase date unless otherwise agreed in writing by Spartan Performance.
3.7 Failure to commence the Trial within 30 days may result in forfeiture of the Trial and all associated services without refund, extension or credit.
4. QUESTIONNAIRE, HEALTH SCREENING & PROGRAMME DESIGN
4.1 Before a Trial can commence, the participant must complete all required onboarding documentation including the Trial Questionnaire, PAR-Q and any additional health screening documentation requested by Spartan Performance.
4.2 The Trial start date cannot be confirmed until all required documentation has been received and reviewed.
4.3 A minimum of 48-72 business hours is required from receipt of all completed documentation before a Trial can commence.
4.4 Spartan Performance accepts one completed questionnaire submission per Trial purchase.
4.5 Once a completed questionnaire has been submitted and programme design has commenced, any request to amend goals, exercise selection, injury history, training availability, preferences or information supplied may require a complete programme rewrite.
4.6 Where a programme rewrite is required, a fee of £50 shall apply.
4.7 Payment must be received in full before any revised programme is written or issued.
4.8 The original Trial fee remains non-refundable and non-transferable regardless of whether a programme rewrite is requested.
4.9 Whilst questionnaire responses are considered, the Trial Programme is designed primarily to introduce participants to Spartan Performance’s facilities, equipment, coaching methods and training systems.
4.10 The Trial Programme should not be considered equivalent to the level of individualisation provided within Silver, Gold or other premium coaching services.
4.11 Spartan Performance retains complete discretion regarding exercise selection, programming structure, coaching methods, training recommendations and programme design decisions.
4.12 Programme design decisions made by Spartan Performance are final.
5. PAYMENT, REFUNDS & DISTANCE SELLING
5.1 Full payment must be received before the Trial can commence.
5.2 Trial purchases are non-transferable.
5.3 Refunds will only be provided where required by applicable UK consumer law or otherwise at the sole discretion of Spartan Performance.
5.4 Trial places may not be exchanged for alternative services, memberships, coaching packages, cash, credit or gift vouchers.
5.5 No refunds, credits, extensions or replacements will be issued for unused services, missed sessions, gym access, class access, sauna access or Red Light Therapy sessions.
5.6 By purchasing the Trial, the participant expressly requests that Spartan Performance begin providing services immediately, including onboarding, questionnaire review, programme design, administration and preparation for participation.
5.7 Once these services have commenced, the participant acknowledges that any statutory right to cancel may be reduced or lost in accordance with applicable UK consumer legislation.
5.8 Where a cancellation request is received after work has commenced, Spartan Performance reserves the right to retain payment for services already provided.
5.9 Nothing within these Terms & Conditions affects your statutory rights under UK consumer law.
6. SEMI-PRIVATE PERSONAL TRAINING
6.1 The Trial includes access to up to nine complimentary Semi-Private Personal Training sessions, subject to availability, advance booking and attendance within the Trial period.
6.2 No minimum number of PT sessions is guaranteed.
6.3 Semi-Private Personal Training consists of one coach working with multiple clients during the same session.
6.4 Participants may train alongside up to three other participants whilst following their own individual programme.
6.5 All PT sessions must be booked in advance.
6.6 PT session availability is subject to coach availability, opening hours and existing bookings.
6.7 Whilst Spartan Performance will make reasonable efforts to accommodate preferences, no guarantee is made regarding specific days, times or coaches.
6.8 All PT sessions must be used within the Trial period.
6.9 Unused PT sessions expire automatically at the end of the Trial period and cannot be carried forward, transferred or exchanged.
6.10 Responsibility for scheduling and attending PT sessions rests entirely with the participant.
6.11 Failure to schedule available PT sessions during the Trial period does not entitle the participant to extensions, refunds, credits or additional sessions.
6.12 PT sessions are provided solely in support of the Trial Programme issued by Spartan Performance.
6.13 A minimum of 24 hours’ notice is required to cancel or reschedule a PT session.
6.14 Cancellations made with less than 24 hours’ notice will be deemed used and forfeited.
7. SPARTAN ONLINE & BOOKINGS
7.1 Spartan Performance operates a private members-only Facebook group known as Spartan Online.
7.2 Spartan Online is the primary platform used for:
• PT bookings
• Class bookings
• Gym announcements
• Timetable updates
• Events
• Coaching support
• Educational content
• Member communications
7.3 Access to Spartan Online is strongly recommended and is considered essential for participants wishing to obtain the maximum benefit from their Trial.
7.4 Whilst Facebook membership is not mandatory, Spartan Performance accepts no responsibility where a participant misses information, booking opportunities, timetable changes, updates or communications due to not joining or regularly checking Spartan Online.
7.5 Participants remain responsible for ensuring they stay informed of all gym communications, policies, updates and booking requirements throughout the Trial.
7.6 Spartan Performance accepts no responsibility for missed bookings, missed communications, missed opportunities, timetable changes or service updates resulting from a participant choosing not to access Spartan Online.
8. CLASSES
8.1 Class access is included within the Trial.
8.2 All classes are subject to availability and must be booked in advance where required.
8.3 Inclusion of class access does not guarantee access to any specific class.
8.4 No specific class, coach, timetable, frequency, date, time or class type is guaranteed as part of the Trial.
8.5 Spartan Performance reserves the right to amend, replace, reschedule or cancel classes at any time.
9. SAUNA ACCESS
9.1 Sauna access is available only to individuals aged 18 years or older.
9.2 Sauna use is subject to all Spartan Performance Sauna Rules, Health & Safety Policies and operating procedures.
9.3 Participants must follow all instructions issued by Spartan Performance staff.
9.4 Spartan Performance reserves the right to refuse sauna access where health, safety or operational concerns exist.
9.5 Sauna access is provided as a complimentary facility benefit.
9.6 Sauna facilities may be unavailable from time to time due to maintenance, repairs, cleaning, operational requirements, health and safety requirements or circumstances beyond Spartan Performance’s reasonable control.
9.7 Temporary unavailability of sauna facilities shall not entitle participants to refunds, credits, extensions or compensation.
10. RED LIGHT THERAPY
10.1 One complimentary Red Light Therapy session is included with the Trial.
10.2 The session is available only to the individual named on the Trial registration.
10.3 The session must be booked in advance.
10.4 The session must be used within the Trial period.
10.5 Unused sessions expire automatically upon completion of the Trial and carry no cash value.
10.6 Red Light Therapy is available only to individuals aged 18 years or older.
10.7 Spartan Performance reserves the right to refuse access where health, safety or operational concerns exist.
10.8 Red Light Therapy is provided as a complimentary bonus service and forms no part of the core value of the Trial.
10.9 Red Light Therapy equipment may be unavailable from time to time due to maintenance, repairs, operational requirements or circumstances beyond Spartan Performance’s reasonable control.
10.10 Temporary unavailability of Red Light Therapy shall not entitle participants to refunds, credits, extensions or compensation.
11. HEALTH DECLARATION
11.1 Participants confirm that all information supplied to Spartan Performance is accurate, truthful and complete.
11.2 Participants agree to immediately notify Spartan Performance of any injury, illness, medical condition or change in health status that may affect participation.
11.3 Spartan Performance may require medical clearance before participation where appropriate.
11.4 Spartan Performance reserves the right to suspend, modify or terminate participation where continued participation may present a health or safety risk.
11.5 Participants acknowledge that failure to disclose relevant injuries, medical conditions, medications, physical limitations or health concerns may affect the suitability, safety and effectiveness of the Trial Programme and may result in modification, suspension or termination of participation.
12. ASSUMPTION OF RISK
12.1 Participation in resistance training, cardiovascular exercise, classes, personal training, sauna use and Red Light Therapy involves inherent risks including injury, illness and, in rare circumstances, serious injury or death.
12.2 Participants voluntarily accept and assume these risks.
12.3 Participants agree to follow all instructions, gym rules, safety procedures and staff directions at all times.
13. TERMINATION
13.1 Spartan Performance reserves the right to terminate a Trial immediately and without refund where a participant:
• Breaches these Terms & Conditions
• Acts in a dangerous or reckless manner
• Fails to follow staff instructions
• Causes damage to facilities or equipment
• Harasses, threatens or abuses staff, coaches or members
• Provides false, misleading or incomplete information
13.2 Spartan Performance reserves the right to terminate the Trial immediately and without refund where a participant behaves in a manner deemed disruptive, unsafe, inappropriate or contrary to the culture, standards or values of Spartan Performance.
14. FACILITY AVAILABILITY & GENERAL TERMS
14.1 From time to time equipment, classes, facilities, coaching services, sauna facilities, Red Light Therapy equipment or other amenities may be unavailable due to maintenance, repairs, upgrades, staffing requirements, events or circumstances beyond Spartan Performance’s reasonable control.
14.2 Such temporary unavailability shall not entitle participants to refunds, credits, extensions, compensation or replacement services.
14.3 The Trial is sold solely on the basis of the services, facilities and benefits described within these Terms & Conditions.
14.4 No verbal statement, social media post, marketing material, staff comment or third-party representation shall alter these Terms & Conditions unless confirmed in writing by Spartan Performance.
14.5 Spartan Performance reserves the right to amend these Terms & Conditions where reasonably necessary.
14.6 Any amendments shall not affect services already delivered.
14.7 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
